Chapter One General Provisions
Article 1 This law is formulated in order to strengthen the management of animal epidemic prevention activities, prevent, control, purify, and eliminate animal diseases, promote the development of the breeding industry, prevent and control zoonotic diseases, and ensure public health safety and human health.
Article 2 This Law applies to animal epidemic prevention and supervision and management activities in the territory of the People's Republic of China.
The "Entry and Exit Animal and Plant Quarantine Law of the People's Republic of China" applies to the quarantine of animals and animal products entering and leaving the country.
Article 3 The “animals” mentioned in this law refer to domestic animals, poultry and other animals raised and captured artificially.
The term “animal products” as used in this Law refers to animal meat, raw hides, raw wool, wool, organs, fat, blood, semen, eggs, embryos, bones, hooves, heads, horns, tendons, and milk and eggs that may transmit animal diseases. Wait.
The animal epidemics mentioned in this law refer to animal infectious diseases, including parasitic diseases.
The term "animal epidemic prevention" as used in this Law refers to the prevention, control, diagnosis and treatment, purification, and elimination of animal epidemics, the quarantine of animals and animal products, and the harmless treatment of dead animals and diseased animal products.
Article 4 According to the degree of harm of animal diseases to the breeding industry and human health, the animal diseases specified in this law are divided into the following three categories:
(1) The first type of disease refers to foot-and-mouth disease, African swine fever, highly pathogenic avian influenza, etc., which pose a particularly serious hazard to humans and animals, and may cause major economic losses and social impacts. It requires urgent and strict compulsory prevention and control. Other measures
(2) The second type of epidemic disease refers to rabies, brucellosis, grass carp hemorrhagic disease, etc., which cause serious harm to humans and animals, which may cause large economic losses and social impacts, and strict prevention and control measures are required;
(3) The three types of diseases refer to common and frequently occurring diseases such as colibacillosis, avian tuberculosis, and turtle mumps, which cause harm to humans and animals, may cause a certain degree of economic loss and social impact, and require timely prevention and control.
The list of specific types of animal diseases in the first, second and third categories of the preceding paragraph shall be formulated and announced by the agricultural and rural administrative department of the State Council. The department in charge of agriculture and rural areas under the State Council shall promptly increase, decrease or adjust the specific types of animal diseases in Category I, II, and III according to the occurrence, prevalence and degree of damage of animal diseases and announce them.
The list of zoonotic infectious diseases shall be formulated and announced by the competent department of agriculture and rural areas of the State Council in conjunction with health and wildlife protection departments of the State Council.
Article 5 Animal epidemic prevention shall implement the policy of focusing on prevention and combining prevention with control, purification and elimination.
Article 6 The state encourages social forces to participate in animal epidemic prevention work. People's governments at all levels have taken measures to support units and individuals participating in animal epidemic prevention publicity and education, epidemic reports, voluntary services, and donations.
Article 7 Units and individuals engaged in animal breeding, slaughter, business, isolation, transportation, and animal product production, business, processing, storage and other activities shall perform immunization, disinfection, and testing in accordance with this Law and the provisions of the agricultural and rural authorities of the State Council , Isolation, purification, elimination, harmless treatment and other animal epidemic prevention work, bear the responsibility of animal epidemic prevention.
Article 8 The people's governments at or above the county level shall exercise unified leadership over animal epidemic prevention, take effective measures to stabilize the grassroots organization team, strengthen the construction of animal epidemic prevention teams, establish and improve animal epidemic prevention systems, and formulate and organize the implementation of animal epidemic prevention and control plans.
The township-level people's government and sub-district offices organize the masses to do a good job in the prevention and control of animal diseases in their jurisdictions, and village committees and residents committees provide assistance.
Article 9 The agricultural and rural administration department of the State Council shall be in charge of animal epidemic prevention work throughout the country.
The agricultural and rural administrative departments of the local people's governments at or above the county level are in charge of animal epidemic prevention in their respective administrative regions.
Other relevant departments of the people's government at or above the county level shall do a good job in animal epidemic prevention within the scope of their respective duties.
The functional department of animal health supervision of the army is responsible for the epidemic prevention of the army's active-duty animals and animals raised for personal use.
Article 10: The health authorities of the people's government at or above the county level and the agriculture, rural, and wildlife protection authorities of the people's government at the same level shall establish a coordination mechanism for the prevention and control of zoonotic diseases.
The department in charge of agriculture and rural areas under the State Council and the General Administration of Customs shall establish a coordination mechanism to prevent the importation of animal diseases from abroad.
Article 11 The animal health supervision agencies of the local people's governments at or above the county level shall be responsible for the quarantine of animals and animal products in accordance with the provisions of this law.
Article 12 The people's governments at or above the county level shall establish animal disease prevention and control institutions in accordance with the provisions of the State Council and in accordance with the principles of overall planning, rational distribution and comprehensive establishment.
Animal disease prevention and control institutions are responsible for the monitoring, testing, diagnosis, epidemiological investigation, epidemic report, and other technical work of prevention and control of animal diseases; and the technical work of animal disease purification and elimination.
Article 13 The State encourages and supports scientific research on animal diseases and international cooperation and exchanges, promotes advanced and applicable scientific research results, and improves the scientific and technological level of animal disease prevention and control.
People's governments at all levels, relevant departments, and news media should strengthen the publicity of animal epidemic prevention laws and regulations and animal epidemic prevention knowledge.
Article 14 People's governments at all levels and relevant departments shall commend and reward units and individuals that have contributed to animal epidemic prevention work, related scientific research, and animal epidemic elimination in accordance with relevant national regulations.
Relevant units shall pay work-related injury insurance premiums for animal epidemic prevention personnel in accordance with the law. Persons who have become ill, disabled or died due to their participation in animal epidemic prevention shall be subsidized or compensated in accordance with relevant state regulations.
Chapter II Prevention of Animal Diseases
Article 15 The State establishes an animal disease risk assessment system.
According to the needs of domestic and foreign animal epidemics and the protection of animal production and human health, the agricultural and rural authorities of the State Council will promptly conduct risk assessments of animal diseases in collaboration with the health and health departments of the State Council, and formulate and announce measures for the prevention, control, purification and elimination of animal diseases. And technical specifications.
The agricultural and rural authorities of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government, together with the health and health departments of the people's governments at the same level, carry out animal disease risk assessments in their administrative regions, and implement animal disease prevention, control, purification, and elimination measures.
Article 16 The State implements compulsory immunization against animal diseases that seriously endanger the production of the breeding industry and human health.
The competent department of agriculture and rural areas under the State Council determines the types and regions of animal diseases for compulsory immunization.
The agricultural and rural administrative departments of the people’s governments of provinces, autonomous regions, and municipalities directly under the Central Government formulate compulsory immunization plans in their respective administrative regions; increase animal disease types and regions for compulsory immunization based on the prevalence of animal diseases in their respective administrative regions, and report to the people’s government at the same level for approval and implementation. Report to the agricultural and rural administrative department of the State Council for the record.
Article 17 Units and individuals that raise animals shall fulfill the obligation of compulsory immunization against animal diseases, implement immunization of animals in accordance with the compulsory immunization plan and technical specifications, and establish immunization files and apply livestock and poultry labels in accordance with relevant national regulations to ensure traceability .
If the animals undergoing compulsory immunization do not meet the immunization quality requirements, and the supplementary immunizations still do not meet the immunization quality requirements, the relevant units and individuals shall deal with them in accordance with relevant national regulations.
Vaccines used for vaccination should meet national quality standards.
Article 18 The agricultural and rural administrative departments of the local people's governments at or above the county level are responsible for organizing the implementation of the compulsory immunization plan for animal diseases, and supervising and inspecting the performance of the compulsory immunization obligations by units and individuals that raise animals.
The township-level people's government and sub-district offices organize the units and individuals that raise animals in their jurisdictions to do compulsory immunization and assist in supervision and inspection; village committees and residents committees assist in relevant work.
The agricultural and rural administrative departments of the local people's governments at or above the county level shall periodically evaluate the implementation and effects of the compulsory immunization plan in their administrative area and announce the evaluation results to the public.
Article 19 The State implements an animal disease monitoring and epidemic early warning system.
People's governments at or above the county level shall establish and improve animal disease monitoring networks and strengthen animal disease monitoring.
The agricultural and rural authorities of the State Council, in conjunction with relevant departments of the State Council, formulate a national animal disease monitoring plan. The agricultural and rural administrative departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall, in accordance with the national animal disease monitoring plan, formulate the animal disease monitoring plan of their administrative region.
The animal disease prevention and control agency monitors the occurrence and prevalence of animal diseases in accordance with the provisions of the agricultural and rural authorities of the State Council and the animal disease monitoring plan; engages in animal breeding, slaughter, operation, isolation, transportation, and animal product production, operation, and processing Units and individuals engaged in activities such as, storage, and harmless treatment shall not refuse or hinder.
The agricultural and rural authorities of the State Council and the agricultural and rural authorities of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall issue early warnings of animal epidemics in a timely manner based on the prediction of the occurrence and epidemic trend of animal diseases. Local people's governments at various levels shall promptly adopt preventive and control measures after receiving an early warning of animal epidemics.
Article 20 The people's governments of land border provinces and autonomous regions shall, in accordance with the needs of animal disease prevention and control, reasonably set up animal disease monitoring stations, improve the monitoring working mechanism, and prevent the introduction of animal diseases from abroad.
Departments such as science and technology, customs, etc. do a good job of monitoring and early warning of animal diseases in accordance with the provisions of this Law and relevant laws and regulations, and regularly communicate with the agricultural and rural authorities, and promptly report emergency situations.
The people's government at or above the county level shall improve the wild animal epidemic disease monitoring system and working mechanism, and rationally arrange monitoring sites as needed; the wildlife protection, agricultural and rural administrative departments shall do a good job in wild animal epidemic disease monitoring according to the division of responsibilities, and communicate regularly. Circumstances, emergency situations are notified in time.
Article 21 The state supports the establishment of non-specified animal epidemic areas in localities, and encourages the construction of animal breeding farms to establish biological safety isolation areas for non-specified animal diseases. For areas with unspecified animal diseases and biological safety quarantine areas without specified animal diseases that meet the standards set by the agricultural and rural authorities of the State Council, the agricultural and rural authorities of the State Council shall announce the acceptance and conduct supervision and inspection of their maintenance.
The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government formulate and organize the implementation of plans for the construction of non-specified animal epidemic areas in their respective administrative regions. The department in charge of agriculture and rural areas of the State Council shall guide the construction of non-specified animal epidemic areas across provinces, autonomous regions, and municipalities directly under the Central Government.
The agricultural and rural authorities of the State Council implement zoning prevention and control of animal diseases based on administrative divisions, the layout of the breeding and slaughter industry, risk assessment, etc., and may take measures such as prohibiting or restricting the trans-regional transportation of specific animals and animal products.
Article 22 The agricultural and rural administrative department of the State Council shall formulate and organize the implementation of plans for the purification and elimination of animal diseases.
The local people's government at or above the county level shall formulate and organize the implementation of the animal disease purification and elimination plan in its administrative area in accordance with the animal disease purification and elimination plan.
Animal disease prevention and control institutions shall carry out technical guidance and training on animal disease purification in accordance with the animal disease purification and elimination plan and plan, and monitor and evaluate the effect of animal disease purification.
The state promotes the purification of animal diseases and encourages and supports units and individuals that raise animals to carry out animal diseases purification. If the units and individuals that raise animals meet the purification standards set by the agricultural and rural administrative department of the State Council, they shall be announced by the agricultural and rural administrative department of the people's government at or above the provincial level.
Article 23 Animals for breeding and dairy use shall comply with the health standards stipulated by the agricultural and rural authorities of the State Council.
Units and individuals that raise animals for breeding or dairy use shall, in accordance with the requirements of the agricultural and rural administrative department of the State Council, regularly carry out animal disease inspections; if the inspection fails, they shall be dealt with in accordance with relevant state regulations.
Article 24: Animal breeding farms and isolation sites, animal slaughter and processing sites, and animal and animal products harmless treatment sites shall meet the following animal epidemic prevention conditions:
(1) The distance between the location of the premises and public places such as residential areas, drinking water sources, schools, hospitals and other public places shall comply with the regulations of the agricultural and rural administration department of the State Council;
(2) The production and operation area is closed and isolated, and the engineering design and related procedures meet the requirements of animal epidemic prevention;
(3) Having sewage and waste treatment facilities, facilities and equipment for the harmless treatment of sick and dead animals, diseased animal products, or refrigeration and freezing facilities and equipment, as well as cleaning and disinfection facilities and equipment that are suitable for their scale;
(4) Having a licensed veterinarian or animal epidemic prevention technical personnel suitable for its scale;
(5) Have a complete animal epidemic prevention system such as isolation and disinfection, purchase and sales accounts, and daily inspections;
(6) Having other animal epidemic prevention conditions prescribed by the agricultural and rural administrative department of the State Council.
In addition to meeting the conditions specified in the preceding paragraph, sites for the harmless treatment of animals and animal products should also have pathogen detection equipment, detection capabilities, and special transport vehicles that meet the requirements for animal epidemic prevention.
Article 25 The State implements a review system for animal epidemic prevention conditions.
For the establishment of animal breeding farms and isolation places, animal slaughtering and processing places, and animal and animal products harmless treatment places, an application shall be submitted to the agricultural and rural administrative department of the local people's government at or above the county level, together with relevant materials. The agricultural and rural authorities that accept the application shall conduct the review in accordance with this Law and the "Administrative License Law of the People's Republic of China". Those who pass the examination shall be issued a certificate of conformity for animal epidemic prevention conditions; those who fail to meet the requirements shall notify the applicant and explain the reasons.
The certificate of animal epidemic prevention conditions shall specify the applicant's name (name), site (factory), animal (animal product) category, etc.
Article 26 Markets dealing with animals and animal products shall meet the animal epidemic prevention conditions prescribed by the agricultural and rural authorities under the State Council, and shall accept the supervision and inspection of the agricultural and rural authorities. The specific measures shall be formulated by the department in charge of agriculture and rural areas under the State Council.
Local people's governments at or above the county level shall, based on local conditions, decide to prohibit live trading of livestock and poultry in specific areas of the city.
Article 27 The means of transport, bedding, packaging, containers, etc. for animals and animal products shall meet the animal epidemic prevention requirements stipulated by the agricultural and rural authorities of the State Council.
Infected animals and their excreta, products of infected animals, animal excrements in vehicles and contaminated items such as litter, packaging, containers, etc., shall be handled in accordance with relevant state regulations and shall not be disposed of at will.
Article 28 The collection, storage, and transportation of animal disease materials or pathogenic microorganisms, as well as the research, teaching, testing, and diagnosis of pathogenic microorganisms, shall comply with the relevant national regulations on the management of pathogenic microorganism laboratories.
Article 29 The slaughter, operation and transportation of the following animals and the production, operation, processing, storage and transportation of the following animal products are prohibited:
(1) Relevant to the occurrence of animal diseases in the sealed-off epidemic area;
(2) Those susceptible to infection in the epidemic area;
(3) Those who are subject to quarantine in accordance with the law but have not been quarantined or are not qualified;
(4) Those infected with or suspected of being infected;
(5) Death due to illness or unknown cause;
(6) Others that do not comply with the relevant animal epidemic prevention regulations of the agricultural and rural administrative department of the State Council.
Where it is necessary to temporarily store and transport animals and animal products due to the implementation of centralized harmless treatment and adopt epidemic prevention measures in accordance with regulations, the provisions of the preceding paragraph shall not apply.
